Nondiscrimination, Title IX, and Section 504 Notice

Stony Creek Joint Unified School District is committed to providing equal opportunity for all individuals in education. District programs, activities, and practices shall be free from unlawful discrimination, including discrimination against an individual or group based on actual or perceived race, color, ancestry, nationality, national origin, immigration status, ethnic group identification, ethnicity, age, religion, marital status, pregnancy, parental status, physical or mental disability, medical condition, sex, sexual orientation, gender, gender identity, gender expression, genetic information, or association with a person or group possessing one or more of these actual or perceived characteristics.

The District prohibits discrimination, harassment, intimidation, bullying, and retaliation in all District programs and activities. This policy applies to all acts related to school activity or school attendance within any school under the jurisdiction of the Superintendent.

The District complies with Title VI of the Civil Rights Act of 1964, Title IX of the Education Amendments of 1972, Section 504 of the Rehabilitation Act of 1973, the Americans with Disabilities Act (ADA), and all applicable state and federal nondiscrimination laws.

Title IX & Gender Equity Statement

Title IX is a federal civil rights law that prohibits discrimination on the basis of sex in educational programs and activities receiving federal financial assistance. The District does not discriminate on the basis of sex and is committed to providing an educational environment free from discrimination, harassment, intimidation, and retaliation.

Pupil Rights Under Title IX (California Education Code § 221.8)

The following list of rights, which are legally mandated by California Education Code Section 221.8, applies to all pupils within the District:

  • The right to fair and equitable treatment and the right to be free from discrimination based on sex.

  • The right to have access to an equitable distribution of athletic benefits and opportunities.

  • The right to receive equitable treatment and benefits in the provision of school athletic programs.

  • The right to have access to a gender equity coordinator to answer questions regarding gender equity laws.

  • The right to contact the California Department of Education (CDE) and the California Interscholastic Federation (CIF) to access information on gender equity laws.

  • The right to file a confidential complaint of discrimination based on sex with the CDE or the local educational agency.

  • The right to pursue civil law remedies and any other remedies available under state or federal discrimination laws.

  • The right to be protected against retaliation for filing a discrimination complaint or participating in an investigation.

  • The right to equal opportunity to participate in all athletic and academic programs, regardless of sex.

  • The right to view the relative participation rate of male and female pupils in sports programs upon request.

Complaint Procedures and Timelines

Uniform Complaint Procedures (UCP)

Complaints alleging unlawful discrimination, harassment, intimidation, or bullying must be filed no later than six (6) months from the date the alleged discrimination occurred, or the date the complainant first obtained knowledge of the facts.

The District will investigate and issue a final written decision within sixty (60) days from the date the written complaint is received, unless an extension is agreed upon in writing.
